Terms of Service

These Terms of Service ("Terms") are an agreement between you and Volatile Apps ("Volatile Apps," "we," "us," or "our"). They apply to the website at volatileapps.com and to every mobile application we publish, including D-Con Social, ParkFinder, Know Your Reps, ShowRadar, and any future or pre-release apps (together, the "Services").

By downloading, installing, accessing, or using any of the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Other Policies That Apply

Each app also has its own policies, which form part of these Terms:

If an app's own policy conflicts with these Terms, the app's policy controls for that app.

2. Eligibility

You must be at least 13 years old to use the Services.
Some apps have a higher minimum age. D-Con Social is strictly 18+, and we will permanently delete any account that belongs to someone under 18.
If you are under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian who agrees to these Terms.

3. Accounts

Some features need an account, for example through Google Sign-In, email, or a connected service such as SIMKL. You agree to:

Give accurate information, and keep it up to date.
Keep your login credentials secure, and not share your account.
Take responsibility for activity that happens under your account.

You can delete your account at any time, using the steps in the relevant app's privacy policy or by contacting us.

4. Your Content

Some apps let you post or send content such as profile details, photos, posts, comments, messages, ratings, and lists ("Your Content").

You own Your Content. We do not claim ownership of it.
License to us: You give Volatile Apps a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit Your Content, solely to operate and provide the Services to you and to the people you choose to share it with. This license ends when you delete Your Content or your account, except for copies we must keep to comply with the law or to enforce these Terms.
Your responsibility: You confirm that you have the right to share Your Content, and that it does not violate these Terms or anyone else's rights, including copyright, privacy, and publicity rights.
Moderation: We may screen, review, hide, or remove content, and restrict accounts, to keep the Services safe. We are not obliged to monitor all content.

5. Acceptable Use

You agree not to use the Services to:

Harass, threaten, bully, stalk, or intimidate anyone.
Post hate speech, or content that promotes violence or discrimination.
Share sexually explicit material, or photos of people taken or shared without their consent.
Sexualize, endanger, or exploit minors in any way. We have zero tolerance for child sexual abuse and exploitation, and we report it as required by law.
Impersonate any person, or misrepresent your identity, age, or badge or attendee status.
Send spam or unsolicited advertising, or run scams.
Break the law, or infringe anyone's intellectual property or privacy.
Reverse engineer, scrape, overload, or interfere with the Services, or try to bypass security features, age checks, or rate limits.
Access another user's account or data without permission.

You can report violations from inside the apps, or by emailing us. We may suspend or permanently ban accounts that break these rules.

6. Location Features

Some apps use your device's location, or a ZIP code you enter, to show nearby parks, theaters, convention venues, or elected officials. Location features are optional, and you control them through your device settings. Distances, drive times, maps, and directions are estimates. Always follow posted signs, local laws, and official guidance, and use your own judgment when traveling or visiting outdoor areas.

7. Third-Party Data and Services

The Services display information from third parties, including government sources (such as Congress.gov, OpenStates, the U.S. Census Bureau, the National Park Service, and Recreation.gov), weather and mapping providers, and media and streaming databases. We also rely on third-party infrastructure (such as Google Firebase, Supabase, and Stream).

This information is provided "as is." It may be incomplete, delayed, or inaccurate, and we do not guarantee it. For official matters, check the original source.
Know Your Reps is not an official government app, and is not affiliated with or endorsed by any government, political party, or campaign.
Links to third-party websites, stores, and ticketing services are provided for convenience. Those services are governed by their own terms and privacy policies.

8. Testing and Pre-Release Apps

Apps offered through a testing program (for example, by joining our Google Group and installing from Google Play testing) are pre-release software. They may contain bugs, change without notice, lose data, or be discontinued. Please don't rely on them for anything important. Feedback you send us may be used to improve the Services without any obligation to you.

9. App Stores

If you download an app from Google Play or the Apple App Store, you also agree to that store's terms. The store is not responsible for the app or its support, and these Terms are between you and Volatile Apps only. If you downloaded an app from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

10. Our Intellectual Property

The Services, including their software, design, text, graphics, logos, and the Volatile Apps name, belong to Volatile Apps or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the apps on devices you own or control, for your own non-commercial use, in line with these Terms. Some of our projects are released as open source. For those projects, the open-source license in their repository applies to their source code.

11. Fees

Our apps are currently free to use. If we add paid features in the future, we will show the price and any extra terms before you are charged. Purchases made through an app store are handled by that store.

12. Suspension and Termination

You may stop using the Services at any time. We may suspend or end your access, remove content, or discontinue any Service at any time, including if you break these Terms or if we are required to by law. Sections 4 (license limits), 7, 10, and 13 through 16 survive termination.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not responsible for the conduct of other users, online or offline. Take sensible precautions when meeting people you connect with through the Services, especially at events.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VOLATILE APPS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50.

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.

15. Indemnification

You agree to defend and hold harmless Volatile Apps from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Services, or your violation of these Terms or of anyone else's rights.

16. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Georgia, unless the law where you live gives you the right to bring a claim locally.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the "Last Updated" date. If a change is significant, we may also notify you in the app. Continuing to use the Services after a change means you accept the updated Terms.

18. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we have not waived it. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition, or sale of assets. These Terms, together with the policies listed in Section 1, are the entire agreement between you and us about the Services.
